Holiday Illness, The Law & Your Rights...

When choosing a holiday destination and browsing through piles of holiday brochures or scanning handfuls of websites, it is the tour operators job to ensure that what you are viewing is a true representation of what you should expect when arriving at your resort.

Package Travel RegulationsThe Package Travel Regulations 1992 Act instantly covers you for illness on holiday when you book your package holiday through a UK tour operator.

This allows you to still be covered, even though you have travelled to a variety of destinations with differing laws along your travels.

This law means that it is the responsibility of the tour operator to make sure that your holiday is safe, clean and enjoyable and allows you to make a claim for food poisoning or illness as a result of misinformation and negligence.

Fault of a HotelIf your holiday sickness is believed to have been caused by a fault of a hotel you stayed at whilst on holiday and you can prove they showed lack of reasonable care and skill in the supply of your holiday, you may be able to pursue a compensation claim against the tour operator.

Investigating what caused your holiday illness at an early stage is crucial with holiday sickness and food poisoning compensation claims. Our expertise and experience enables us to quickly understand all the issues involved in your case and find the right solicitor for you.

It is important to look out for tour operators that often class their holidays as ‘packages’ and this is not always the case.

If you purchase a hotel stay, but then add on an additional item such as transfers or flights and they were sold to you as one overall price and under the one contract, for a period of over 24 hours then this would be classed as a ‘Package’ and you are eligible to make a holiday claim.

If you have become sick when abroad in the last 3 years, you may be eligible to make a claim for compensation. Any case has to be issued in court within 3 years from the date you became ill.

Although only a small proportion of cases would go that far, for this reason, we advise you get in touch within 2 ½ years of you becoming ill.

We work on a No Win No Fee basis...

Meaning that you’ll never be at financial risk when using us for your Holiday Illness Claim.

With no up-front costs, we will work with you to ensure that if you do lose your case, you won’t have to pay a penny from your own pocket.  We will discuss the option of taking out an After The Event Insurance Policy (ATE) to ensure that you are safeguarded.

Working with you, we want there to be no risk to you at all when claiming holiday compensation.

Throughout the claims process, our team of highly skilled solicitors will keep you updated on how we are moving forward to ensure that you obtain the compensation you deserve for a dream holiday that has been completely ruined by an illness that was out of your control.
